Marketing Consent Notice
Counsel-review draft for an adult customer's optional choice to receive promotional email from a participating U.S. business.
Separate, optional choice
Joining a loyalty program or checking in does not by itself require marketing consent. The customer must be able to make a separate, affirmative choice about promotional email without losing access to ordinary service or earned rewards.
What consent covers
The disclosure must name the business, describe the expected message categories, identify Retrakor as the delivery platform, and explain that frequency varies by customer activity. Retrakor's current controls permit no more than 100 promotional messages per business per day and no more than one promotional message to the same recipient within 24 hours. Those are platform maximums, not a promise that a recipient will receive that volume. Consent is business-specific and is not permission for unrelated senders.
Withdrawal
Every promotional retention message includes a visible, signed unsubscribe link and one-click unsubscribe headers. A valid unsubscribe, complaint, bounce, or consent revocation suppresses future promotional sends. Required security, account, billing, check-in, and requested service messages may continue when lawful.
Sender identification
Messages must use truthful sender and subject information, identify the participating business, include the approved mailing address—304 S. Jones Blvd., #1297, Las Vegas, Nevada 89107—and provide a working unsubscribe method. The current platform sender is Retrakor <hello@notify.retrakor.com>. The business must not disguise the source or use misleading claims.
Evidence and responsibility
Retrakor records the disclosure version, source, time, grant or revocation, and delivery suppression needed to honor the choice. Consent and suppression evidence may be retained for five years after the last relevant event. The subscribing business remains responsible for its offers, audience, message content, and compliance with applicable marketing, consumer-protection, industry, and recordkeeping rules.
Pilot boundaries
The pilot covers email only; SMS, calls, and other marketing channels are not authorized. It is limited to U.S. businesses, adult recipients, general adult audiences, and non-regulated industries. Purchased or scraped lists, minor-directed marketing, sensitive profiling, and age-restricted promotional campaigns remain prohibited. Each live campaign still requires separate business, audience, content, consent, sender, and stop-condition approval.
