Controlled-pilot policy

Terms of Service

Counsel-review draft for U.S. businesses using Retrakor's managed loyalty, check-in, and email service.

Owner-approved for the controlled pilot—attorney review pending. This policy is effective only when incorporated into a named participant's accepted pilot acknowledgment. It is not a public offer or final public-release policy.

1. Contracting entity and eligibility

These Terms are drafted for BlueprintMedia LLC, a Nevada limited-liability company doing business as Retrakor, at 304 S. Jones Blvd., #1297, Las Vegas, Nevada 89107, United States. The customer must be a U.S. business, and its signer must be at least 18, have authority to bind the business, and provide accurate account, billing, and contact information. Regulated businesses, minor-directed services, and sensitive-data uses are excluded unless separately reviewed and agreed in writing.

2. Service

Retrakor provides a hosted business workspace that can include assisted setup, QR check-in, staff-confirmed loyalty rewards, customer reward access, approved automated retention email, reporting, hosting, updates, and customer-success support. Same-day setup is a best-efforts target after payment and receipt of complete, usable inputs, not a guaranteed service level.

3. Trial, charges, and renewal

The current product offers a seven-day no-card business trial. Continued use then requires a one-time, nonrefundable $499 setup fee and enrollment in a $49 monthly managed service. The first $49 charge is scheduled 30 days after the setup payment, and the subscription renews monthly until canceled. Prices exclude applicable taxes. See the draft Refund and Cancellation Policy.

4. Customer responsibilities

  • Use accurate customer and staff information and protect account credentials and tablets.
  • Offer lawful rewards and send marketing only with valid, separate consent.
  • Honor advertised rewards, customer choices, and unsubscribe requests.
  • Review business branding, messages, links, and campaign timing before activation.
  • Do not submit sensitive data, data about minors, purchased lists, or scraped contacts.
  • Comply with the Acceptable Use Policy and laws applicable to the business, industry, and recipients.

5. Cancellation, nonpayment, and termination

The customer may cancel future renewal in its account or through support. Access continues only through the recorded trial or paid service period. A failed renewal has a seven-day cure window, but service may be deactivated during that window. When access ends, the workspace, QR destinations, check-in and loyalty links, automated email, hosting, updates, and support are disabled. An authorized customer may request an export for 120 days after deactivation. Cancellation does not transfer the hosted product, software, source code, infrastructure, or domains.

6. Data and intellectual property

The customer retains rights in the business and customer content it submits and is responsible for lawful notices, authority, consents, and instructions. Retrakor owns its software, templates, service, infrastructure, and improvements. During an active subscription, the customer receives a limited, revocable, nontransferable right to use the hosted service for its internal business operations.

7. Warranty, indemnity, and liability draft

The service is provided as available without a promise of uninterrupted operation, inbox placement, revenue, or a particular result. To the maximum extent permitted by law, neither side is liable for indirect, special, incidental, punitive, or consequential damages. Except for fraud, willful misconduct, gross negligence, data or confidentiality misuse, payment or indemnity obligations, and nonwaivable rights, proposed aggregate liability is capped at fees paid or payable during the preceding 12 months. The customer would defend and indemnify Retrakor against third-party claims arising from its offers, content, customer data, unlawful instructions, lack of authority, or missing consent. Qualified counsel must approve this section before unrestricted launch.

8. Governing law, contact, and changes

Nevada law would govern, with exclusive venue in state or federal courts in Clark County, Nevada. This draft does not require arbitration or waive class procedures. Support and legal requests may be sent to support@notify.retrakor.com. Material changes should be dated, communicated in advance when practical, and accepted when required. The intended public effective date remains unset pending qualified legal review.
