Controlled three-client pilot

Controlled Pilot Participation Acknowledgment

Owner-approved interim terms for no more than three named U.S. business pilots while the public-release legal package awaits qualified counsel.

Owner-approved interim pilot terms—attorney review pending. Effective September 24, 2026, this version may be used only with a named pilot participant after both sides accept it and retain the required dated record. It does not authorize unrestricted public enrollment or claim to replace qualified legal advice.

1. Parties, effective date, and pilot limit

These interim terms are effective September 24, 2026 between BlueprintMedia LLC, a Nevada limited-liability company doing business as Retrakor ("Retrakor"), and the named business participant. Retrakor's mailing address is 304 S. Jones Blvd., #1297, Las Vegas, Nevada 89107, United States. This is a business-to-business pilot, not a consumer offer. Retrakor may enroll no more than three named U.S. businesses. Before access or a charge, both sides must retain a dated record identifying the participant's legal name, authorized adult signer, workspace, locations, pilot dates, price or credit, setup inputs, support contact, exclusions, and acceptance evidence.

2. Eligibility and excluded uses

The participant and signer must be located in the United States, the signer must be at least 18 and authorized to bind the business, and the pilot may serve only a general adult audience. Health care, financial services, government, education involving minors, age-restricted goods, and other regulated businesses are excluded. The participant must not submit health information, financial-account or card data, government identifiers, information about minors, or other sensitive data. Age-restricted promotional campaigns and support-email attachments remain disabled.

3. Service and setup

The pilot includes a hosted loyalty program, assisted configuration, QR check-in, staff-confirmed loyalty activity, customer reward access, reporting, automated retention-email capability after separate campaign approval, hosting, product updates, and customer-success support. Retrakor targets same-day setup after the $499 payment and receipt of complete, usable business content, branding, reward rules, locations, and authorized contacts; this is a best-efforts target, not a guaranteed service level. The participant must review and approve its offers, content, links, branding, and customer disclosures.

4. Trial, charges, renewal, and taxes

A participant may first use a seven-day, no-card business trial. Trial access deactivates at the end of day seven unless the participant completes Checkout. Checkout then charges a one-time, nonrefundable $499 setup fee and creates a $49-per-month managed-service subscription. The first $49 charge is scheduled 30 days after the setup payment, and the subscription renews monthly until canceled. Prices exclude taxes; Retrakor may collect taxes it is required to collect, and the participant is responsible for other applicable transaction taxes. Any written pilot credit or discount must appear in the dated pilot record before Checkout.

5. Cancellation, failed payment, and deactivation

The participant may cancel future renewal through its account or by contacting support. Access continues only through the provider-recorded trial or paid service period. After a failed renewal, the participant has seven calendar days to cure the payment, but service may be deactivated during that cure window. If payment is not cured, or when a cancellation becomes effective, the business account remains deactivated; hosted workspaces, QR destinations, customer check-in and loyalty links, automated email, hosting, updates, and support stop working. A later successful payment may restore service after provider confirmation. Cancellation does not transfer Retrakor's software, source code, infrastructure, domains, or hosted service to the participant.

6. Refunds

The $499 setup fee is nonrefundable once paid and setup work begins. Monthly charges are nonrefundable and are not prorated after a service period begins. Retrakor will review duplicate, unauthorized, or incorrectly calculated charges and a documented material failure to provide agreed setup work. Any approved refund is returned through the original payment provider. These rules do not limit rights that cannot lawfully be waived. The interim Refund and Cancellation Policy supplies the detailed process.

7. Participant responsibilities

  • Provide accurate business, owner, staff, billing, location, and service information.
  • Use only authorized staff accounts and protect devices and credentials.
  • Offer lawful, accurate rewards and honor earned benefits and customer choices.
  • Give customers required notice when collecting data and obtain separate affirmative marketing consent before promotional email.
  • Use only the participant's own customers and lawful lists; purchased, scraped, or shared marketing lists are prohibited.
  • Follow the Acceptable Use Policy and promptly report suspected unauthorized access or uncontrolled sending.

8. Data, privacy, and email

The participant controls the customer data, notices, offers, audiences, and instructions it supplies; Retrakor processes that data to operate, secure, support, analyze, and improve the service as described in the interim Privacy Notice. Retrakor does not sell or share personal information for cross-context behavioral advertising and does not use it to train artificial-intelligence models. Retrakor may use aggregated or de-identified information for analytics and product improvement. Promotional email must use accurate sender and subject information, identify the business, include Retrakor's approved postal address and a working unsubscribe method, and honor suppression and withdrawal records.

9. Data at exit

The participant retains ownership of its submitted business and customer content. After deactivation, an authorized participant may request a reasonable machine-readable export through support for 120 days. Eligible operational data is then deleted or de-identified under the Data Retention and Deletion Policy, subject to billing, consent, suppression, security, audit, legal-hold, dispute, and backup exceptions. Retrakor is not required to preserve or provide access after the applicable period.

10. Support and incidents

Support is available at support@notify.retrakor.com from 9:00 a.m. to 5:00 p.m. Pacific, Monday through Sunday. Retrakor targets an initial response within 24 hours during coverage hours, but does not promise a resolution time, uninterrupted availability, or service credits. Retrakor may pause a campaign, account, integration, or pilot to contain unauthorized access, data exposure, duplicate charges, uncontrolled sending, provider failure, or another material risk.

11. Ownership, warranty, and risk allocation

Retrakor owns its service, software, templates, infrastructure, and improvements; the participant receives only a limited, revocable right to use the hosted service during an active pilot. To the maximum extent permitted by law, the pilot is provided as available without a promise of uninterrupted operation, inbox placement, customer participation, revenue, or a particular business result. Neither side is liable for indirect, special, incidental, punitive, or consequential damages. Except for fraud, willful misconduct, gross negligence, misuse of the other side's confidential information or data, payment duties, indemnity duties, or rights that cannot be limited, each side's total liability is capped at fees paid or payable under the pilot during the preceding 12 months. The participant is responsible for claims arising from its offers, content, unlawful instructions, lack of authority, or failure to obtain required consent.

12. Nevada law and changes

Nevada law governs these terms without regard to conflict-of-law rules. State and federal courts located in Clark County, Nevada have exclusive jurisdiction, and each side consents to that venue. There is no mandatory arbitration or class-action waiver in this interim version. A change is effective only when recorded in a dated written amendment accepted by both sides. If a term is unenforceable, the remainder continues to the extent lawful.

13. Required acceptance record

The private pilot record—not Git—must contain this version and URL, the participant legal name and signer authority, signer email, agreed scope and exclusions, exact price and credits, start and end dates, support contact, Retrakor approver, both parties' electronic acceptance evidence, and UTC timestamps. Anthony Scott is Retrakor's internal pilot approver. The electronic record must be retainable and reproducible, and a copy must be provided to the participant before the first charge.

14. Legal-review boundary

Anthony Scott approved this interim package for the controlled pilot on September 24, 2026. It has not been reviewed or approved by an attorney and is not represented as legal advice or as sufficient for every business or jurisdiction. Unrestricted enrollment, a fourth participant, public self-service acceptance, regulated or minor-directed use, age-restricted promotional sending, and claims that the public legal package is final remain blocked until qualified counsel reviews and Retrakor approves the complete package.
